What Is Form DHA-31?

Form DHA-31 — also referred to as BI-31 — is the Declaration for the Purpose of Marriage, also known as a letter of no impediment. It is required when a foreign national is marrying in South Africa and must declare that they have no existing legal impediment to marriage (i.e., they are not currently married to someone else).

South African citizens marrying in South Africa do not need DHA-31 — their status is verifiable through the National Population Register.


Who Needs Form DHA-31?

You need Form DHA-31 if you are a foreign national who is:

  • Getting married inside South Africa, and
  • Your home country cannot be easily verified through South African systems

The form declares, under oath, that you are legally free to marry — you are not currently married, or if previously married, that the previous marriage has been legally dissolved by divorce or death.


How to Complete DHA-31

The form requires your full name, passport details, nationality, country of birth, and a sworn declaration that you are free to marry. It must be signed in the presence of a commissioner of oaths, a notary public, or a DHA official.

  • Completed Form DHA-31
  • Valid passport (original and certified copy)
  • If previously married: original divorce decree (apostilled and translated into English if not in English) or original death certificate of former spouse

Does a South African citizen need DHA-31 to marry a foreign national? No. The South African citizen’s marital status is verified through the NPR. Only the foreign national party needs DHA-31.
